1. Introduction and Acceptance of Terms

Welcome to the official website for TankSafe® in Kuwait, the GCC, Middle East, and Africa, operated by Apex Technology Marketing & Trading Co. W.L.L. (“we,” “us,” “our”). These Terms and Conditions (“Terms”) constitute a legally binding agreement governing your access to and use of our website, [Your Website URL], including all content, functionality, and services offered on or through it (collectively, the “Service”).

2. Scope of Service and Regional Exclusivity

Apex Technology Marketing & Trading Co. W.L.L. is the sole and exclusive authorized distributor of TankSafe® products for the territories of Kuwait, the Gulf Cooperation Council (GCC) nations (Saudi Arabia, United Arab Emirates, Qatar, Bahrain, Oman), the wider Middle East, and the continent of Africa.
All sales, services, and warranties processed through this Service are applicable only to customers and installations within these specified territories. Inquiries and orders from outside these regions may be redirected to the appropriate global distributor. The information, pricing, and promotions on this Service are intended for and limited to our designated operational territories.
 

3. Intellectual Property Rights

The Service and its entire contents, features, and functionality—including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof—are owned by TankSafe Global Ltd., Apex Technology Marketing & Trading Co. W.L.L., or their licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • Trademarks: The names “TankSafe®,” “Apex Technology,” the company logos, and all related names, logos, product and service names, designs, and slogans are trademarks of TankSafe Global Ltd. or Apex Technology. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners.
  • Limited License: These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business use for the purpose of evaluating and purchasing our products. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as is automatically done by your web browser for display purposes or as expressly permitted.
Any use of the Service not expressly permitted by these Terms is a breach of this agreement and may violate copyright, trademark, and other laws.

  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Attack the Service via a denial-of-service (DoS) attack or a distributed denial-of-service (DDoS) attack.

5. Product Information, Pricing, and Availability

We strive to ensure that all information on the Service, including product descriptions, specifications, compatibility guides, and pricing, is accurate and up-to-date. However, we do not warrant the accuracy, completeness, or reliability of any information on the Service.
  • Pricing: All prices are listed in the currency specified at the time of purchase (e.g., KWD, USD, AED) and are subject to change without notice. Prices do not include shipping costs, insurance, or any applicable taxes, duties, and customs fees, which are the sole responsibility of the buyer.
  • Availability: Product availability is subject to change without notice. We reserve the right to discontinue any product at any time. We cannot guarantee that a product listed as “in stock” will be available for immediate shipment, especially for large volume orders. In such cases, we will notify you of the expected lead time.
  • Errors and Omissions: In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or an error in information received from our suppliers, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price. We reserve this right whether or not the order has been confirmed and your payment has been processed. If your payment has already been processed and your order is canceled, we will issue a credit to your original method of payment in the amount of the charge.

6. Orders, Payment, and Cancellation

  • Order Acceptance: Your placement of an order does not necessarily assure that we will accept your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in product or pricing information, or issues identified by our credit and fraud avoidance department.
  • Payment: We accept payment via the methods specified on our website at the time of purchase. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any transaction.
  • Cancellation: You may request to cancel an order before it has been dispatched. Please refer to our Shipping & Delivery Policy for details. Once an order has been dispatched, it cannot be canceled and will be subject to our Refund & Return Policy.

7. Shipping, Delivery, Title, and Risk of Loss

All matters related to the shipment and delivery of products are governed by our Shipping & Delivery Policy, which is incorporated by reference into these Terms. Title to products and risk of loss or damage passes to you upon our transfer of the goods to the designated shipping carrier.

8. Warranty and Disclaimers

  • Product Warranty: All TankSafe® products are covered by the TankSafe® 3-Year Ironclad Warranty & 100% Performance Guarantee. The terms, conditions, limitations, and claim procedures of this warranty are detailed in the warranty document, which is incorporated by reference into these Terms. This express warranty is the sole and exclusive warranty provided for the products.
  • Disclaimer of Other Warranties: EXCEPT FOR THE EXPRESS WARRANTY STATED ABOVE, THE SERVICE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER APEX TECHNOLOGY NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.
  • TO THE FULLEST EXTENT PERMITTED BY LAW, WE HEREBY DISCLAIM ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APEX TECHNOLOGY MARKETING & TRADING CO. W.L.L., ITS AFFILIATES, THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE, OR THE PURCHASE AND USE OF ANY PRODUCTS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE OR PRODUCTS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US FOR PRODUCTS IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) $100 USD.

10. Indemnification

You agree to defend, indemnify, and hold harmless Apex Technology Marketing & Trading Co. W.L.L., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service’s content, services, and products other than as expressly authorized in these Terms.

11. Governing Law and Jurisdiction

All matters relating to the Service and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the laws of the State of Kuwait, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the commercial courts of Kuwait. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Changes to the Terms and Conditions

We reserve the right, in our sole discretion, to revise and update these Terms from time to time. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
