The warranty does not cover damage or failures resulting from actions or events beyond the product’s intended use and design parameters, a standard practice for industrial-grade equipment globally.
The following are explicitly excluded from warranty coverage:
  • Incorrect, Unauthorized, or Improper Installation: The performance of TankSafe® is directly linked to its correct installation. Damage or failure resulting from installation that does not follow our official international guidelines is not covered.
  • Acts of Vandalism, Tampering, or Deliberate Abuse: The warranty does not cover damage caused by intentional misuse, such as attempting to pry the device open, striking it with heavy objects, or otherwise trying to forcibly bypass its security features. This is a universal exclusion for security products.
  • Damage from Severe Accidents or Collisions: While robust, the device may be damaged in a major vehicle accident, fire, flood, or other catastrophic events (force majeure). Such external events are not covered under this manufacturing and performance warranty.
  • Use of Contaminated Fuel or Unapproved Additives: Damage to the device caused by highly corrosive chemicals, contaminated fuel, or non-standard fuel additives that degrade the device’s materials is excluded.
  • Normal Wear and Tear: Minor cosmetic issues, such as surface scratches or slight discoloration that do not impact the structural integrity or functionality of the device, are considered normal wear and tear under global industry standards.
  • Consequential Financial Losses: Our liability is strictly limited to the product itself. The warranty does not cover indirect or consequential losses, such as vehicle downtime, lost business opportunities, driver wages, or third-party claims unrelated to the direct failure of the TankSafe® device.

5. Filing a Warranty Claim: A Simple and Efficient Process

We have designed our warranty claim process to be as straightforward and hassle-free as possible. Our goal is to resolve your issue quickly and get your vehicle back to being fully protected.

  4. Technical Review and Verification: Our dedicated technical team will promptly review the submitted evidence to verify the claim and determine the cause of the failure.
  5. Claim Resolution: Once the claim is approved, our team will contact you to confirm the resolution. TankSafe® will, at its discretion, repair the defective unit, ship a replacement unit, or issue a credit note for the product’s value.
Key Timelines and Responsibilities:
  • Claim Reporting: Claims must be reported within 7 days of discovering the issue to ensure timely resolution.
  • Return Shipping: The buyer is responsible for the cost of shipping the defective unit back to our designated service center for inspection.
  • Replacement Shipping: TankSafe® covers the full cost of shipping the repaired or replacement unit back to the buyer.
  • Customs and Duties: The buyer remains responsible for any customs duties, taxes, or import fees associated with international shipments.
  • Processing Time: Approved claims are typically processed and resolved within 30 business days from the receipt of the defective unit.

6. Limitation of Liability and Governing Law

This section outlines the legal framework of our warranty to ensure clarity and fairness for all parties.
Limitation of Liability: The liability of Apex Technology Marketing & Trading Co. W.L.L. and TankSafe® under this warranty is strictly and exclusively limited to the repair, replacement, or credit value of the specific product unit found to be defective. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to:
  • Lost profits or revenue.
  • Loss of business opportunities.
  • Costs associated with fleet downtime.
  • The cost of fuel lost due to incidents not covered by this warranty (e.g., tampering).
  • Claims made by third parties.
This limitation of liability is a fundamental term of the agreement and reflects the price at which the products are sold.
Governing Law and Dispute Resolution: This TankSafe® Warranty Policy shall be governed by and construed in accordance with the laws of the State of Kuwait. Any dispute, controversy, or claim arising out of or relating to this warranty shall be settled through commercial arbitration in Kuwait, in accordance with the rules of the relevant arbitration body, unless an alternative dispute resolution mechanism is specified in a formal distributor agreement.

The TankSafe Warranty Policy is governed by the laws of the State of Kuwait.
Disputes shall be resolved via commercial arbitration in Kuwait, unless otherwise outlined in distributor agreements.

10. TankSafe Warranty — FAQs

A: Every genuine TankSafe® device is protected by a 3-Year Limited Warranty, which begins on the date of the original invoice.
A: The warranty and performance guarantee specifically cover fuel theft via siphoning through the filler neck “functional anti-siphon mechanism.” It does not cover fuel theft from cut fuel lines, drilled tanks, or other methods that bypass the TankSafe® device. However, physical damage caused by thieves tampering with the device is not covered.
